Terms of Use

1. Introduction

These Terms of Use govern your access to and use of Domus, a rental property and tenancy record platform operated by Breathe Technology d.o.o.

By creating an account, starting a trial, subscribing to Domus, accepting a tenant invitation or using the service, you agree to these Terms.

If you do not agree to these Terms, you must not use Domus.

2. Who we are

Domus is operated by Breathe Technology d.o.o., company registration number / matični broj 22147781, PIB 115366147, with its registered office / headquarters at Luke Ćelovića Trebinjca 40, 11102 Belgrade (Savski Venac), Serbia.

Breathe Technology d.o.o. is the platform operator. We own and manage the Domus platform and provide access to its functionality as a technology platform provider.

We are not a party to any agreement, tenancy, lease, transaction, payment, dispute or arrangement between users. We do not act as a landlord, tenant, employer, broker, agent, intermediary, property manager or representative of any user.

3. Key definitions

In these Terms:

• Domus means the rental property and tenancy record platform operated by Breathe Technology d.o.o.
• Account means a user account used to access Domus.
• Landlord account means an account used by a landlord, property owner, property investor, property manager or authorised representative to create and manage property and tenancy records.
• Tenant account means an account used by an invited tenant to access shared tenancy records.
• Property record means a record connected to a physical rental property.
• Active property means a property record that is not archived and counts toward the landlord's plan limit.
• Archived property means a property record that is no longer actively managed in Domus and is read-only.
• Tenancy record means a record connected to a specific tenancy or lease period for a property.
• Shared tenancy record means a tenancy record that a landlord shares with an invited tenant through Domus.
• Invited tenant means a tenant who has been invited by a landlord to access a shared tenancy record.
• User Content means records, files, notes, comments, documents, photos, images and other content uploaded, entered or submitted by users.
• Read-only mode means a restricted access state where records remain available to view, but new changes, submissions or updates are disabled.
• Subscription means a paid Domus plan purchased through Paddle.
• Paddle means the payment provider and Merchant of Record used for checkout, billing, taxes, invoices, payment method details and subscription payments.
• Data or Personal Data means any fact presented in a formalised form, such as a number, image or word, and includes personal data as defined under applicable data protection laws, including, where applicable, Article 4(1) of the General Data Protection Regulation (EU) 2016/679 (GDPR) and Article 4 of the Serbian Law on Personal Data Protection (Official Gazette of the Republic of Serbia no. 87/2018).
• Intellectual Property or IP means intangible assets and legally protected rights arising from original creations of the mind. This includes, but is not limited to, copyrights, patents, trademarks, trade secrets, design rights and proprietary know-how, whether registered or unregistered.
• Law means all applicable statutes, regulations, ordinances, decrees, rulebooks and any binding acts issued by government authorities that govern the Services or their use.
• Platform Operator means the legal entity that owns and manages the platform and provides access to its functionalities as a platform provider. The Platform Operator is responsible for maintaining the technological infrastructure necessary for the Platform's operation. The Platform Operator is not a party to any agreement or transaction between users and does not act as a landlord, tenant, employer, broker, agent, intermediary or representative of any user.
• Services means the Domus platform, website, applications, tools, features, records, account functionality, support and related services provided by or on behalf of Breathe Technology d.o.o.
• Terms or Terms of Use means this agreement, including all policies and guidelines incorporated by reference and any amendments we publish.
• You means the individual or entity accessing or using the Platform or Services.

4. What Domus does

Domus helps landlords organise rental property and tenancy records in one place. Depending on the modules used, Domus may help record rent status, utilities and bills, deposits, lease documents, keys, maintenance, entry condition reports, exit condition reports and tenancy closeout information.

Landlords can invite tenants to access shared tenancy records. Tenants can view shared records and, where enabled, submit updates for landlord review or confirmation.

5. What Domus does not do

Domus is a record platform. Domus does not:

• Provide legal advice.
• Provide tax advice.
• Provide accounting advice.
• Provide property management advice.
• Act as a rent payment processor.
• Collect rent on behalf of landlords.
• Verify whether rent has legally been paid or owed.
• Decide whether a deposit should be returned.
• Resolve disputes between landlords and tenants.
• Guarantee that records will be accepted by a court, authority or third party.
• Screen tenants.
• Create tenant scores, landlord scores or public rental ratings.
• Make automated decisions about tenancy eligibility.

Users are responsible for getting professional advice where needed.

6. Eligibility and account access

You must have reached the age of majority and possess the legal capacity to enter into binding contracts under the laws of your country of residence. If you register on behalf of a legal entity, landlord, property owner, property manager or other organisation, you represent and warrant that you have authority to bind that entity or organisation to these Terms.

You must provide accurate account information, keep your login details secure and take responsibility for activity under your account. You must not share access with unauthorised people.

You must only create or manage a property or tenancy record if you have authority to do so. If you invite a tenant or other user, you are responsible for making sure you are authorised to share the relevant record with them.

You agree to use the Services only for purposes that are consistent with these Terms, governing law, industry standards and regulations, any additional policies and guidelines issued by us, and not harmful to the integrity, security or functionality of the Platform.

Know Your Customer (KYC) procedures

We reserve the right to request identity verification or supporting documentation during account creation or at any time afterwards where reasonably necessary to:

• confirm your identity and ownership of the account;
• validate information you provide;
• comply with applicable laws and regulations, including anti-money laundering, counter-terrorist financing and sanctions screening requirements;
• prevent fraud, unauthorised access or misuse of the Platform;
• investigate suspected violations;
• enforce these Terms; or
• maintain the integrity and security of our Services.

We may restrict, suspend or terminate access to the Services if requested verification or supporting documentation is not provided, appears inaccurate, or gives us reasonable grounds to believe that continued access may create legal, security, fraud or misuse risk.

7. Landlord and tenant access

Landlord accounts create and manage property records and tenancy records. Tenant accounts access only the shared tenancy records they are invited to. Tenants do not have access to a landlord's private property records or unrelated tenancy records.

Tenant access is controlled by the shared tenancy record. Tenant access may become read-only when a tenancy ends, if the landlord changes the primary tenant for the record, if the landlord subscription is inactive or if the property or tenancy record is read-only. Tenants do not have paid subscription obligations in the current Domus model.

8. Subscriptions, plans and active property limits

Domus is offered on annual paid plans:

• Individual, €49 per year, 1 active property.
• Investor, €99 per year, up to 5 active properties.
• Portfolio, €299 per year, up to 20 active properties.

Billing is annual. Tenant access is included when a landlord invites a tenant. Plan limits are based on active properties, not tenancy records. An active property is a property record that has not been archived. Archived properties do not count toward active property limits. Domus may prevent creation of additional active property records when the plan limit is reached.

9. Free trial

Domus may offer a 14-day free trial. Payment details are required to start the trial. Unless cancelled before the trial ends, annual billing begins automatically after the trial period according to the selected plan. You are responsible for cancelling before the trial ends if you do not want to be charged.

There is no free account tier unless Domus explicitly states otherwise.

10. Payments and Paddle

Payments are processed by Paddle. Paddle may act as Merchant of Record and handles checkout, payment method details, billing, taxes, invoices, receipts, renewals, cancellations, refunds and order support. Domus does not collect or store card details directly.

Domus receives subscription and access status from Paddle. Subscription changes may take a short time to sync from Paddle to Domus. By purchasing, you also agree to the Paddle Buyer Terms available at paddle.net.

11. Cancellation, payment failure and read-only mode

You may cancel your subscription through Paddle where available. Cancellation stops future renewals but does not automatically create a refund for a paid period, unless a refund is approved under the Refund Policy.

If your subscription is inactive, payment needs attention or access has expired, Domus may place your account or related records into read-only mode. In read-only mode, records remain available to view, but new changes, submissions, uploads and updates may be disabled. Domus does not automatically delete records because a subscription becomes inactive.

12. User content and responsibility

You are responsible for the records, files, notes, comments, documents, photos and other content you enter, upload or submit through Domus. You must only upload content that you have the right to use and share, and that is relevant to the rental property or tenancy record.

You must ensure content is accurate to the best of your knowledge. You must not upload unlawful, harmful, misleading, abusive, confidential or third-party content unless authorised. You should avoid uploading unnecessary sensitive personal data. Domus does not verify the truth, legality or completeness of user content.

13. Licence to operate the service

You retain ownership of your content. By entering, uploading or submitting content to Domus, you give Breathe Technology d.o.o. a limited right to host, store, copy, process, display and share that content as needed to operate Domus, provide the service, maintain security, create backups, provide support and make the content available to authorised users according to the product's access rules.

14. Acceptable use

You must not, and must not allow any third party to, directly or indirectly:

• use Domus unlawfully;
• use the Services in any manner beyond the scope of rights expressly granted in these Terms;
• access records you are not authorised to access;
• attempt to bypass security or access controls;
• upload malicious code or harmful files;
• interfere with or disrupt the integrity, performance or security of the Service, or any data or content within or transmitted through the Service;
• misrepresent identity or authority;
• use Domus to harass, threaten or abuse another person;
• upload unlawful, harmful, misleading, abusive or unauthorised content;
• reverse engineer, disassemble, decompile, decode or otherwise attempt to derive or gain improper access to any component of the Services, in whole or in part;
• use scraping, data mining, automated extraction or similar techniques to collect or extract data from the Services;
• modify or create derivative works of the Services, in whole or in part;
• use the Services in any manner or for any purpose that infringes, misappropriates or otherwise violates our intellectual property rights or any third party's intellectual property rights, whether registered or unregistered;
• use Domus for tenant screening, public scoring or automated eligibility decisions;
• use Domus to process rent payments outside its intended record-keeping purpose;
• use the Services or any confidential information for benchmarking or competitive analysis with respect to competitive or related products or services;
• use the Services or confidential information to develop, market, license or sell any product, service or technology that could, directly or indirectly, compete with Domus or its Services; or
• use our name, trademarks, service marks, trade dress or other branding in any marketing or promotional activities or materials that are false, misleading, deceptive or likely to cause confusion as to affiliation, sponsorship, partnership, endorsement or approval by us, unless you have our prior written consent.

We have the right to monitor your compliance with these Terms and your use of the Services generally. We reserve the right to suspend, restrict, place into read-only mode or terminate access to the Services if any prohibited use is detected or suspected.

15. Service availability and changes

We may update, improve, suspend or change parts of Domus from time to time. We aim to provide a reliable service, but we do not guarantee that Domus will be uninterrupted, error-free or available at all times.

16. Third-party services

Domus may rely on third-party services to provide checkout, authentication, hosting, storage, email delivery, security, monitoring and support. Your use of those services may also be subject to their own terms and policies.

17. Privacy

Our Privacy Policy explains how we collect, use and protect personal data. See /privacy-policy.

18. Refund Policy

Refunds, where available, are handled according to our Refund Policy and the Paddle process. See /refund-policy.

19. Intellectual property

Our Intellectual Property. The Platform, Services and all related technology and materials are owned by us or our licensors. This includes, for example, our software, algorithms, designs, branding, documentation, content, infrastructure, know-how and other proprietary materials.

Nothing in these Terms transfers ownership of any Intellectual Property rights to you. You may use the Platform and Services only as expressly permitted under these Terms.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and non-sublicensable right to access and use the Services. This right allows you to use the Services but does not give you ownership of the Platform, software, technology or any related Intellectual Property.

You may not copy, modify, distribute, reverse engineer, decompile, disassemble or otherwise attempt to access the source code of the Services, except where permitted by applicable law.

Any unauthorised use of our Intellectual Property is prohibited.

Our Content. The Platform, our Services, social media accounts and other channels we operate may contain text, graphics, images, videos, audio, designs and other content owned by us or used with permission.

Unless we expressly allow it in writing, you may not copy, reproduce, distribute, publish, modify, sell, create derivative works from, or otherwise use our content for commercial or public purposes.

You retain ownership of your User Content, subject to the licence granted to us under these Terms so that we can operate and provide the Services.

20. Disclaimers

• Domus is provided on an "as is" and "as available" basis to the extent permitted by law.
• Domus does not guarantee that any record entered into the service is accurate, complete, legally sufficient or accepted by a court, authority, landlord, tenant or other third party.
• Domus does not guarantee uninterrupted or error-free service.
• Domus does not verify user content.
• Domus does not replace legal, tax, accounting, property management or dispute resolution advice.
• Users remain responsible for the information they enter and the decisions they make.

Only information communicated through our official channels is considered authorised by us. We are not responsible for statements, promises, marketing materials or other representations made by affiliates, referral partners or other third parties unless expressly approved by us in writing. To the fullest extent permitted by law, we disclaim liability for any reliance on such unauthorised communications.

21. Limitation of liability

To the maximum extent permitted by applicable law, Breathe Technology d.o.o. is not liable for indirect, incidental, special, consequential or punitive damages, loss of profit, loss of business, loss of goodwill or loss arising from reliance on user-entered records.

To the maximum extent permitted by applicable law, our aggregate liability for any claim relating to the service is limited to the fees you paid for Domus in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

22. Termination and restriction of access

You may stop using Domus at any time. Landlords may cancel subscriptions through Paddle where available.

Domus may restrict, suspend, place into read-only mode or terminate access for breach of these Terms, non-payment, security concerns, misuse, legal requirement, suspected unauthorised access or harm to Domus or other users. Read-only mode may be used instead of full termination where appropriate.

Termination does not automatically delete all records immediately. Certain records may be retained as described in the Privacy Policy, or as required by legal obligations, backup cycles or business records.

23. Changes to these Terms

We may update these Terms from time to time. The latest version will be published on this page with an updated date. If we make material changes, we will take reasonable steps to notify users where required. Continued use of Domus after the updated Terms take effect means you accept the updated Terms.

24. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, except to the extent that mandatory provisions of governing law provide otherwise.

Any dispute arising out of or relating to these Terms shall be submitted to the competent courts in Belgrade, Serbia, except where mandatory governing law grants consumers the right to bring proceedings before another court.

26. Miscellaneous

Entire agreement. These Terms, together with any documents expressly incorporated by reference, including our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior and contemporaneous agreements, communications, representations and understandings, whether oral or written, relating to their subject matter.

Except as expressly provided in these Terms, neither party has relied on any statement, representation, warranty or promise not contained in these Terms. Any amendment to these Terms must be made in accordance with these Terms or otherwise agreed in writing by the parties.

Severability. If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall remain in full force and effect.

Relationship of the parties. The parties are independent contractors. Nothing in these Terms creates any partnership, joint venture, agency, employment, fiduciary or similar relationship between the parties. Neither party has authority to bind the other except as expressly agreed in writing.

No third-party beneficiaries. These Terms are intended solely for the benefit of you and us and do not confer any rights or remedies on any third party, except where expressly stated otherwise.
